Asset ownership on exit

Name the website, the content, the ad accounts, the tracking numbers and the CRM configuration explicitly. Tracking numbers are the most commonly overlooked: losing them means losing the number printed on every van and yard sign.

Data portability

Historic performance data, call recordings and lead records should be exportable. An agency that cannot export them is holding your history.

Scope creep in both directions

Define what a month of work includes. Vague scopes get under-delivered in quiet months and over-charged in busy ones.
